Data We Collect

2.1 Identification & Contact: full name, email address, phone number (including WhatsApp), and mailing address. We do not collect Social Security Numbers or tax IDs through this website.

2.2 Financial Data: information about assets, income, financial goals, and investor profile, collected solely for the provision of advisory services.

2.3 Communication Data: history of interactions via WhatsApp Business and SMS in the context of service delivery.

2.4 Browsing Data: IP address, device type, browser, and pages visited, collected via cookies and similar technologies.

Purpose of Data Processing

3.1 Service Delivery (Contract Performance): creating financial plans, managing investments, and providing strategic guidance.

3.2 WhatsApp Business API (Consent — TCPA): sending meeting reminders, service updates, informational campaigns, and promotions. Only to clients who have given prior express written consent, as required by the TCPA.

3.3 SMS Communications (Consent — TCPA): meeting reminders, service notifications, and promotional communications. Only to numbers voluntarily provided with prior express written consent, in compliance with the TCPA (47 U.S.C. § 227).

3.4 Legal Obligations: compliance with applicable US federal and state financial regulations.

3.5 Legitimate Interest: service improvement, fraud prevention, and operational security.

WhatsApp Business API

4.1 Express Written Consent (TCPA): WhatsApp messages are sent exclusively to clients who have provided prior express written consent, as required by the Telephone Consumer Protection Act (TCPA). Consent is obtained when you voluntarily provide your number and agree to receive messages.

4.2 Message Types: meeting reminders, service updates, informational campaigns, and financial product promotions.

4.3 Opt-out: reply "STOP" to any message to immediately cancel. You will receive one final confirmation message. Our CRM processes opt-out requests officially and immediately. You may also contact [email protected].

4.4 Compliance: our use of the WhatsApp Business API complies with WhatsApp's Acceptable Use Policy, Meta Platforms, Inc. guidelines, and the US TCPA.

SMS Communications — TCPA Compliance

5.1 Prior Express Written Consent (TCPA): we send SMS messages only to individuals who have provided prior express written consent, as required by the TCPA (47 U.S.C. § 227). Phone numbers are collected exclusively from clients who voluntarily provided their information through official Laive Agency channels.

5.2 Purpose: meeting reminders, appointment confirmations, service notifications, and promotional campaigns (when specifically consented to).

5.3 Message Frequency & Rates: message frequency varies; you may receive up to 4 messages per month. Standard message and data rates may apply depending on your carrier.

5.4 Opt-out: reply STOP to any SMS to immediately cancel. You will receive one final confirmation message. Reply HELP for assistance. Our CRM processes opt-out requests officially and immediately.

5.5 Confidentiality: phone numbers are treated as confidential data and are not sold or shared with third parties for marketing purposes.

Data Sharing

Laive Agency does not sell, rent, or transfer personal data to third parties for commercial purposes. Sharing occurs only with: (a) Service Providers contractually bound to the same protection standards (CRM, WhatsApp API and SMS providers); (b) Authorities when required by law or court order; and (c) for Rights Protection in cases of fraud or contractual disputes.

Data Security

We implement encryption in transit and at rest (SSL/TLS), role-based access controls (RBAC), continuous monitoring, staff training, and internal information security policies. In the event of a security incident, we will notify affected individuals and relevant US authorities within the timeframes required by applicable federal and state law.

Your Rights

You have the right to: access your personal information; correct inaccurate data; delete your data; opt out of marketing communications; and revoke consent at any time.

California Residents (CCPA/CPRA): you have additional rights, including the right to know what data we collect, the right to delete, the right to opt out of the sale of personal information (we do not sell your data), the right to correct inaccurate information, and the right to non-discrimination for exercising these rights.

Data Retention

Active client data: during the contractual relationship and up to 5 years after termination, as required by US financial regulations. Communication data (WhatsApp and SMS): up to 4 years for TCPA consent verification. Browsing data: up to 12 months.
